Terms of Service
These Terms of Service (the “Terms”) govern your access and use of the PolicyValidator services and website (collectively, the “Service”) offered by Multifamily Internet Ventures, LLC (“MIV”). Your continued access and use of the Service will constitute your acceptance of these Terms. MIV reserves the right to modify these Terms at any time via posting to this website.
PolicyValidator Service
PolicyValidator provides a secure website for apartment residents to upload and validate their renters insurance policies in accordance with the requirements established by their apartment community property management. The service provides processing and evaluation of the uploaded insurance policies, with notification and reporting on policy compliance with the apartment owners and/or managers designated mandatory minimum insurance lease requirements. Review of uploaded policies will include, but not be limited to, (i) verification of adherence to designated minimum insurance requirements, (ii) matching of named insured(s) with designated resident(s), (iii) confirmation of policy coverage dates, and (iv) confirmation of proper interested party designations.
The Service also includes the option to purchase renters insurance coverage through an integration with eRenterPlan. All eRenterPlan services are offered by MIV and subject to the eRenterPlan privacy policy available at https://www.erenterplan.com/Privacy. Insurance agency license disclosures for MIV are available at https://www.erenterplan.com/AgencyLicense.
Privacy and Passwords
The Service is subject to the privacy policy and practices posted at https://www.policyvalidator.com/Privacy
Some portions of the Service are protected and require authentication for access. By establishing user authentication credentials, you agree that MIV is permitted to act upon any instructions received using such credentials and to consider such instructions as authorized by you. Unauthorized access or use of such portions of the Service is prohibited. You agree that you will notify MIV immediately if you believe that a third party has obtained your login information, or if you believe that any unauthorized access or use may occur or has occurred. For your protection, if MIV believes that any unauthorized Service access may occur or has occurred, we reserve the right to terminate your authentication credentials and restrict access to the Service without prior notice to you.
Third-Party Sites
At times, the Site may have links to websites hosted by other parties ("Third-Party Sites"), or such Third-Party Sites may have links to the PolicyValidator website. These links are offered as a convenience and for informational purposes only, not as referrals or endorsements by MIV of the Third-Party Sites. The Third-Party Sites are maintained by their respective organizations, and those organizations are solely responsible for the content of their own websites. MIV makes no warranty or representation about the content, products, services, intellectual property, privacy practices, or compliance of such Third-Party Sites.
Disclaimer of Warranties
MIV AND ITS AFFILIATES MAKE NO REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, TRUTH, AVAILABILITY, ACCURACY OR COMPLETENESS OF THE SERVICE. MIV AND ITS AFFILIATES DO NOT REPRESENT OR WARRANT THAT (A) THE USE OF THE SERVICE WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE OR OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM OR DATA, (B) THE SERVICE WILL MEET USER’S REQUIREMENTS OR EXPECTATIONS, (C) ANY STORED DATA, INCLUDING BUT NOT LIMITED TO USER DATA, WILL BE ACCURATE OR RELIABLE, (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY USER THROUGH THE SERVICE WILL MEET USER’S REQUIREMENTS OR EXPECTATIONS, (E) ERRORS OR DEFECTS WILL BE CORRECTED, OR (F) THE SERVICE OR THE SERVER(S) THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SERVICE IS PROVIDED TO USER STRICTLY ON AN “AS IS” BASIS. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW BY MIV.
Limitation of Liability
TO THE FULLEST EXTENT PERMITIED BY APPLICABLE LAW, IN NO EVENT SHALL MIV OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) USE OF THE SERVICE; (II) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT WITHIN THE SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVERS, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY, (VI) ANY LOSS OF DATA OR CONTENT UPLOADED TO OR OFFERED THROUGH THE SERVICE (VII) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT MIV AND ITS AFFILIATES ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND/OR (VIII) THE DISCLOSURE OF INFORMATION PURSUANT TO THESE TERMS OR OUR PRIVACY POLICY. DESPITE THE LIMITATIONS SET FORTH HEREIN, UNDER NO CIRCUMSTANCES WILL MIV AND ITS AFFILIATES’ TOTAL LIABILITY TO YOU FOR ANY CAUSE OF ACTION YOU TAKE AGAINST US EXCEED ONE HUNDRED DOLLARS ($100 00).
Intellectual Property Rights
The Service and its contents are intended solely for the use of PolicyValidator users and may only be used in accordance with these Terms. MIV (and its affiliates and licensors, where applicable) shall own all right, title and interest, including all related intellectual property rights, in and to the MIV technology supporting the Service and the content and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by users or any other party relating to the Service. This Service is protected by copyright pursuant to US copyright laws, international conventions, and other copyright laws. User may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works base on, distribute, perform, display, or in any way exploit, any of the content, software, materials, or Service, in whole or in part. These Terms do not convey to user any rights of ownership in or related to the Service, the content of the Service, or the intellectual property rights owned by MIV. The “PolicyValidator” name and logo, are trademarks of MIV or third parties, and no right or license is granted to use them. Accordingly, user will not reproduce, transmit, publish or distribute such content to any third party without the express written consent of MIV, which may be granted or withheld in MIV’s sole and absolute discretion.
General Terms
These Terms shall be governed, construed and enforced in accordance with the laws of the State of Texas (without regard to the principles of conflicts of law). This Agreement has been entered into in Dallas County, Texas and it shall be performable for all purposes in Dallas County, Texas. Any action or proceeding concerning, related to, regarding, or commenced in connection with the Service must be brought in a state or federal court located in Dallas County, Texas, a nd you hereby irrevocably submit to the personal jurisdiction of such courts and waive any objection they may now or hereafter have as to the venue of any such action or proceeding brought in any such court, or that any such court is an inconvenient forum.
If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the invalid or unenforceable provision(s), with all other provisions remaining in full force and effect. The failure of MIV to enforce any right or provision in this Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by MIV in writing.
